These terms and conditions ("Terms") govern the sale of Non-Fungible Tokens ("NFTs") linked to en primeur offerings of prestigious Bordeaux wines. The sale is conducted through the platform "Crypto.com" ("Platform") in collaboration with various prestigious châteaux and InterCellar.io ("InterCellar").
The product is an NFT, representing a digital twin of a 75cl physical bottle of Bordeaux wine from select châteaux. The packing (number of bottles) varies for each château and is specified accordingly, typically ranging from 1 to 6 bottles per NFT. Purchasing en primeur provides access to highly sought-after vintages at favorable prices, with the primary benefit being the acquisition of a digital twin of the bottle. Additional benefits, such as château visits, may be offered on a case-by-case basis.
NFTs may be exchanged on Crypto.com for a period extending until October 4, 2024, without incurring storage fees. During this period, NFT holders may transfer their NFTs to the InterCellar platform. Subsequently, a one-month grace period is provided for NFT transfers.
Following the expiration of this grace period, NFT holders will receive a final notice, granting a one-week period to complete the transfer. Should the NFT not be transferred within this final one-week period, the holder shall forfeit all rights and ownership of the NFT, which will be automatically transferred to the principal wallet of InterCellar. Concomitantly, the holder will lose all associated rights and benefits pertaining to the bottle.
As these wines are en primeur offerings, physical bottles are not immediately deliverable. Therefore, no storage fees will be applied until the bottles become deliverable, expected in 2026. Once the bottles become deliverable, storage fees will apply as per InterCellar's terms and conditions.
Please be advised that, in accordance with the terms and conditions, a storage fee of €1.20 per item, per annum, will be applied to each Non-Fungible Token (NFT), irrespective of whether itrepresents a single-bottle wooden case, a magnum, a six-bottle case, or a three-bottle case.
Failure to pay storage fees prohibits the user from reselling or redeeming the NFT on the platform.Storage conditions are detailed in InterCellar's terms and conditions: InterCellar Terms &Conditions
Shipping of physical bottles is only available once the bottles become deliverable, expected in 2026. Shipping fees will apply, and buyers are responsible for any customs fees and taxes.
By purchasing an NFT, buyers agree to adhere to these Terms and any additional terms specified by Crypto.com and InterCellar.io. These Terms constitute the entire agreement between the parties regarding the sale of NFTs linked to Bordeaux en primeur offerings.
